Arbitration
For many years, legal practice has criticised construction litigation for excessively long proceedings and increasingly unpredictable outcomes. This is largely due to insufficient court staffing and a structural lack of specialist knowledge among judges dealing with construction matters. It is therefore unsurprising that the construction industry increasingly avoids state courts in construction and plant engineering disputes and chooses other procedures to determine such disputes.
Arbitration is a form of such out-of-court dispute resolution which, however, can be enforced with the assistance of the state in a manner similar to a civil court judgement.. It thus links dispute determination delegated to third parties with state enforcement. Arbitration is therefore governed by statutory procedural law setting minimum rule-of-law standards for orderly proceedings and regulating the review and enforcement of arbitral awards.
